The Secretary shall have the power to issue a cease and desist order to any person violating any provision of this chapter ordering such person to cease and desist from such violation, provided that any cease and desist order issued pursuant to this section shall expire:
(1) After 30 days of its issuance; or
(2) Upon withdrawal of said order by the Secretary; or
(3) When the order is superseded by an injunction.
Terms Used In Delaware Code Title 7 Sec. 9118
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Person: means an individual, firm, corporation, association, partnership, consortium, joint venture, commercial entity, state government agency, unit of local government, school district, conservation district, federal government agency, Indian tribe or interstate body. - Secretary: means Secretary of the Department or the Secretary's designee. See Delaware Code Title 7 Sec. 9103
