- Contract: A legal written agreement that becomes binding when signed.
- in writing: includes any representation of words, letters, or figures, whether by writing, printing, or other means. See Texas Government Code 312.011
A merchant may not:
(1) sell a loss damage waiver unless:
(A) the contract containing the waiver complies with this chapter; and
(B) the consumer agrees to the waiver in writing; or
(2) impose or require the purchase of a loss damage waiver as a mandatory charge.
