(a) In this section, “lease” includes a sublease.
(b) After the analysis required under § 437.163(b), if applicable, the department may lease property to any person.

- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Property: means real and personal property. See Texas Government Code 311.005
(c) The law requiring notice and competitive bids does not apply to a lease under this section.
