(1) An adjudicative proceeding under this title, including a disciplinary proceeding, is a civil action, notwithstanding whether at issue in the adjudicative proceeding is a violation of statute that can be prosecuted criminally.
Terms Used In Utah Code 32B-3-201
- Adjudicative proceeding: means :(2)(a) an action by a board, commission, department, officer, or other administrative unit of the state that determines the legal rights, duties, privileges, immunities, or other legal interests of one or more identifiable persons, including an action to grant, deny, revoke, suspend, modify, annul, withdraw, or amend an authority, right, or license; and(2)(b) judicial review of an action described in Subsection (2)(a). - Commission: means the Alcoholic Beverage Services Commission created in Section
32B-2-201 . See Utah Code 32B-1-102- Disciplinary proceeding: means an adjudicative proceeding permitted under this title:
(35)(a) against a person subject to administrative action; and(35)(b) that is brought on the basis of a violation of this title. See Utah Code 32B-1-102- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Statute: A law passed by a legislature.
(2) Unless specifically adopted in this title, a procedure or principle that is applicable to a criminal proceeding does not apply to an adjudicative proceeding permitted under this title including:(2)(c) Title 76, Chapter 3, Punishments; and(3)(3)(a) The burden of proof in an adjudicative proceeding under this title is by a preponderance of the evidence.(3)(b) If the subject of an adjudicative proceeding under this title asserts an affirmative defense, the subject has the burden of proof to establish the affirmative defense by the preponderance of the evidence.(4) In an adjudicative proceeding under this title, to find a violation of this title the commission:(4)(a) is required to determine whether the conduct that constitutes the violation occurred; and(4)(b) is not required to make a finding of knowledge or intent unless knowledge or intent is expressly made an element of the violation by statute. - Commission: means the Alcoholic Beverage Services Commission created in Section
