Terms Used In Utah Code 73-32-303

  • Commissioner: means the Great Salt Lake commissioner appointed under Section 73-32-201. See Utah Code 73-32-101
  • Council: means the Great Salt Lake Advisory Council created in Section 73-32-302. See Utah Code 73-32-101
  • Department: means the Department of Natural Resources. See Utah Code 73-32-101
  • Land: includes :
         (18)(a) land;
         (18)(b) a tenement;
         (18)(c) a hereditament;
         (18)(d) a water right;
         (18)(e) a possessory right; and
         (18)(f) a claim. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) The council shall advise the persons listed in Subsection (1)(b) on the sustainable use, protection, and development of the Great Salt Lake in terms of balancing:

          (1)(a)(i) sustainable use;
          (1)(a)(ii) environmental health; and
          (1)(a)(iii) reasonable access for existing and future development.
     (1)(b) The council shall advise, as provided in Subsection (1)(a):

          (1)(b)(i) the governor;
          (1)(b)(ii) the Department of Natural Resources;
          (1)(b)(iii) the Department of Environmental Quality; and
          (1)(b)(iv) the commissioner.
(2) The council shall assist the Division of Forestry, Fire, and State Lands in the Division of Forestry, Fire, and State Land‘s responsibilities for the Great Salt Lake described in Sections 65A-17-201 and 65A-17-202.
(3) The council:

     (3)(a) may recommend appointments to the Great Salt Lake technical team created by the Division of Forestry, Fire, and State Lands; and
     (3)(b) shall receive and use technical support from the Great Salt Lake technical team.
(4) The council shall assist the department, the Department of Environmental Quality, and their applicable boards in accomplishing their responsibilities for the Great Salt Lake.
(5) The council shall report annually to the Natural Resources, Agriculture, and Environmental Quality Appropriations Subcommittee on the council’s activities.
