(a) The department may refuse to register a vehicle if

Terms Used In Alaska Statutes 28.10.041

  • action: includes any matter or proceeding in a court, civil or criminal. See Alaska Statutes 01.10.060
  • commercial motor carrier: means a person that provides transportation for compensation, or that provides a vehicle to a person or entity that provides transportation for compensation, including the person's agents, officers, representatives, employees responsible for hiring, supervising, training, assigning, or dispatching of drivers, and employees overseeing the safety, installation, inspection, and maintenance of motor vehicle equipment and accessories.   • department: means the Department of Administration. See Alaska Statutes 28.90.990
  • Fraud: Intentional deception resulting in injury to another.
  • highway: means the entire width between the boundary lines of every way that is publicly maintained when a part of it is open to the public for purposes of vehicular travel, including but not limited to every street and the Alaska state marine highway system but not vehicular ways or areas. See Alaska Statutes 28.90.990
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • motor vehicle: means a vehicle which is self-propelled except a vehicle moved by human or animal power. See Alaska Statutes 28.90.990
  • owner: means a person, other than a lienholder, having the property in or title to a vehicle, including but not limited to a person entitled to the use and possession of a vehicle subject to a security interest in another person, but exclusive of a lessee under a lease not intended as security. See Alaska Statutes 28.90.990
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
  • property: includes real and personal property. See Alaska Statutes 01.10.060
  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060
  • vehicle: means a device in, upon, or by which a person or property may be transported or drawn upon or immediately over a highway or vehicular way or area. See Alaska Statutes 28.90.990
  • vehicular way or area: means a way, path, or area, other than a highway or private property, that is designated by official traffic control devices or customary usage and that is open to the public for purposes of pedestrian or vehicular travel, and which way or area may be restricted in use to pedestrians, bicycles, or other specific types of vehicles as determined by the Department of Public Safety or other agency having jurisdiction over the way, path, or area. See Alaska Statutes 28.90.990
(1) the application contains a false or fraudulent statement;
(2) the applicant fails to furnish information required by the department;
(3) the applicant is not entitled to the issuance of a certificate of title or registration under this chapter;
(4) the vehicle is determined to be mechanically unsafe to be driven or moved on a highway, vehicular way or area, or other public property in the state;
(5) the department has reasonable grounds to believe that the vehicle was stolen or fraudulently acquired or that the granting of registration would be a fraud against the rightful owner or other person having a valid lien on the vehicle;
(6) the registration of the vehicle has been suspended or revoked for any reason under the laws of the state;
(7) the required fees or taxes have not been paid;
(8) the vehicle or applicant fails to comply with this chapter or regulations implementing this section;
(9) the vehicle is without a certificate of inspection required under Alaska Stat. § 19.10.310;
(10) except for a vehicle to be registered under Alaska Stat. § 28.10.152, the vehicle is subject to a state-approved emission inspection program adopted under Alaska Stat. § 46.14.400 or 46.14.510, and the vehicle does not meet the standards of that program;
(11) the applicant fails to certify to the department the existence of a motor vehicle liability policy that complies with Alaska Stat. § 28.22.101 for the vehicle being registered unless the owner of the vehicle qualifies as a self-insurer under Alaska Stat. § 28.20.400 or is exempted from obtaining liability insurance under Alaska Stat. § 28.22.011;
(12) the applicant is a commercial motor carrier prohibited from operating by a federal agency.
(b) When the department refuses to register a vehicle, it shall immediately notify the applicant stating the reasons for the action and informing the applicant of the right to a hearing under Alaska Stat. § 28.05.13128.05.141.
(c) Except for a vehicle to be registered under Alaska Stat. § 28.10.152, the department shall refuse to register a vehicle subject to the federal heavy vehicle use tax required by 26 U.S.C. § 4481 (Internal Revenue Code of 1954) if the applicant fails to furnish proof, in the form prescribed by the United States Secretary of the Treasury, that the tax has been paid.
(d) The department shall refuse to register a vehicle if the applicant fails to register the vehicle using the applicant’s full first, middle, and last name or a business name.
