Sec. 8. As used in this chapter, “subcontractor” means a person that:
(2) provides services or work for work the contractor is performing under either of the following:
(1) is a party to a contract with a contractor; and

- Contract: A legal written agreement that becomes binding when signed.
- contractor: means a person that satisfies either of the following:

- person: means an individual, a corporation, a limited liability company, a partnership, or another legal entity. See Indiana Code 22-5-1.7-4
- public agency: has the meaning set forth in IC 5-30-1-11. See Indiana Code 22-5-1.7-6.2
- public contract for services: means any type of written agreement between a state agency or political subdivision and a contractor for the procurement of services. See Indiana Code 22-5-1.7-6
- public works project: has the meaning set forth in IC 5-16-13-6. See Indiana Code 22-5-1.7-6.4
(A) A public contract for services.
(B) A contract for a public works project with a public agency.
