Terms Used In Maryland Code, CORRECTIONAL SERVICES 3-604

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • state: means :

    (1) a state, possession, territory, or commonwealth of the United States; or

    (2) the District of Columbia. See
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
(a) If an inmate is granted a rehearing or new trial by a court asserting jurisdiction over an offense for which the inmate is confined and the case record maintained under § 3-601 of this subtitle must be provided to the court or a correctional facility to which the inmate is transferred, the State shall reimburse the correctional facility or political subdivision for the cost of providing the record.

(b) The State shall make the payment described under subsection (a) of this section:

(1) through the Administrative Office of the Courts;

(2) after proper certification; and

(3) on a monthly basis.
