1. A person commits the crime of odometer fraud in the third degree if, with the intent to defraud, he operates a motor vehicle less than twenty years old on any street or highway knowing that the odometer of the motor vehicle is disconnected or not functioning.

2. Odometer fraud in the third degree is a class C misdemeanor.
