1.    The secretary of state shall collect the following fees when a filing is made under this chapter:

Terms Used In North Dakota Code 10-01.1-03

  • following: when used by way of reference to a chapter or other part of a statute means the next preceding or next following chapter or other part. See North Dakota Code 1-01-49
  • Process: means a writ or summons issued in the course of judicial proceedings. See North Dakota Code 1-01-49
  • Service of process: The service of writs or summonses to the appropriate party.
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See North Dakota Code 1-01-49
  • written: include "typewriting" and "typewritten" and "printing" and "printed" except in the case of signatures and when the words are used by way of contrast to typewriting and printing. See North Dakota Code 1-01-37

a.    Commercial registered agent listing, one thousand dollars; b.    Commercial registered agent termination statement, five hundred dollars; c.    Statement of change, ten dollars except when the change is a change of address and in the secretary of state’s opinion that change results from rezoning or postal reassignment; d.    Statement appointing an agent for service of process, ten dollars; and e.    Any process, notice, or demand for service, twenty-five dollars.

2.    The secretary of state shall collect the following fees for copying and certifying a copy of any document filed under this chapter:

a.    The fee provided in section 54-09-04 for copying a record; b.    Fifteen dollars for furnishing a certificate; and

c.    Five dollars for a search of records when supplying copies, certification, or written verification of facts.

3.    The secretary of state may not collect a fee to file a statement of resignation.
