Terms Used In Texas Estates Code 1022.006
- Court: means and includes:
(1) a county court in the exercise of its probate jurisdiction;
(2) a court created by statute and authorized to exercise original probate jurisdiction; and
(3) a district court exercising original probate jurisdiction in a contested matter. See Texas Estates Code 22.007 - Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Person: includes a natural person and a corporation. See Texas Estates Code 22.027
- Probate: Proving a will
A statutory probate court has concurrent jurisdiction with the district court in:
(1) a personal injury, survival, or wrongful death action by or against a person in the person’s capacity as a guardian; and
(2) an action involving a guardian in which each other party aligned with the guardian is not an interested person in the guardianship.
