(a) In selecting an application for the compact waste disposal facility license, the commission shall:
(1) issue notice of the opportunity to submit an application to dispose of low-level radioactive waste in accordance with § 401.228;
(2) review all applications received under Subdivision (1) for administrative completeness;
(3) evaluate all administratively complete applications in accordance with the evaluation criteria established by Sections 401.233-401.236 and shall select the application that has the highest comparative merit in accordance with § 401.232; and
(4) review the selected application under Subdivision (3) for technical completeness and issue a draft license in accordance with Sections 401.237 and 401.238.
(b) If the selected application is rejected or denied by the commission, the commission may select the next highest comparative merit application and proceed in accordance with Subsection (a)(4).
