Notwithstanding the provisions of Alaska Stat. § 12.55.035(b) and (c), a person convicted of an offense under Alaska Stat. § 16.10.76016.10.780 may be sentenced to pay a fine not exceeding the greater of

(1) $100,000;

Terms Used In Alaska Statutes 16.10.790

  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
(2) three times the pecuniary gain realized by the person as a result of the offense; or
(3) if the person is convicted under Alaska Stat. § 16.10.760, two times the fair market value of the salmon involved or contemplated in the commission of the offense.
