(a) Before the disposition hearing of a delinquent minor, the department shall submit a predisposition report with a recommended plan of treatment to aid the court in its selection of a disposition, a victim impact statement reporting the information set out in Alaska Stat. § 12.55.022, and any further information that the court may request. In preparing the predisposition report, the department shall contact the victim of the minor’s offense.

Terms Used In Alaska Statutes 47.12.130

  • action: includes any matter or proceeding in a court, civil or criminal. See Alaska Statutes 01.10.060
  • court: means the superior court of the state. See Alaska Statutes 47.12.990
  • department: means the Department of Family and Community Services. See Alaska Statutes 47.12.990
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • minor: as used in this chapter includes a person described in this section. See Alaska Statutes 47.12.022
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
  • victim: has the meaning given in Alaska Stat. See Alaska Statutes 47.12.990
  • Victim Impact Statement: A written or spoken statement by the victim or his or her representative about the physical, emotional, and financial impact of a crime on the victim. The statement is given to the court before sentencing.
(b) The court shall inform the minor, the minor’s parents, and the attorneys representing the parties and the guardian ad litem that the predisposition report will be available to them not less than 10 days before the disposition hearing.

(d) In this section, “parents” means the natural or adoptive parents, and any legal guardian, relative, or other adult person with whom the minor has resided and who has acted as a parent in providing for the minor for a continuous period of time before this action.
