Notwithstanding § 9020C of this title, a state agency may disclose personal information if the disclosure is:
(1) Necessary to perform the specific statutory duties of the state agency that collected or is collecting the personal information, or required by state or federal law or regulation;
(2) Made pursuant to a court order or by law; or
(3) If the information is used solely for statistical purposes and is in a form that cannot be used to identify any particular person.
Terms Used In Delaware Code Title 29 Sec. 9021C
- Disclose: shall mean to reveal, release, transfer, disseminate or otherwise communicate information orally, in writing or by electronic or other means, other than to the person who is the subject of such information. See Delaware Code Title 29 Sec. 9017C
- Personal information: shall include , but not be limited to, any information concerning a natural person which, because of name, number, symbol, mark or other identifier, can be used to identify that natural person. See Delaware Code Title 29 Sec. 9017C
- State: means the State of Delaware; and when applied to different parts of the United States, it includes the District of Columbia and the several territories and possessions of the United States. See Delaware Code Title 1 Sec. 302
