Washington Code 71A.10.020Department: means the department of social and health services. See Washington Code 71A.10.020 Developmental disability: means a disability attributable to intellectual disability, cerebral palsy, epilepsy, autism, or another neurological or other condition of an individual found by the secretary to be closely related to an intellectual disability or to require treatment similar to that required for individuals with intellectual disabilities, which disability originates before the individual attains age eighteen, which has continued or can be expected to continue indefinitely, and which constitutes a substantial limitation to the individual. See Washington Code 71A.10.020 Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs. Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006. Legal representative: means a parent of a person who is under eighteen years of age, a person's legal guardian, a person's limited guardian when the subject matter is within the scope of the limited guardianship, a person's attorney-at-law, a person's attorney-in-fact, or any other person who is authorized by law to act for another person. See Washington Code 71A.10.020 person: may be construed to include the United States, this state, or any state or territory, or any public or private corporation or limited liability company, as well as an individual. See Washington Code 1.16.080 Residential habilitation center: means a state-operated facility for persons with developmental disabilities governed by chapter 71A. See Washington Code 71A.10.020 Secretary: means the secretary of social and health services or the secretary's designee. See Washington Code 71A.10.020 Service request list: means a list of eligible persons who have received an assessment for service determination and their assessment shows that they meet the eligibility requirements for the requested service but were denied access due to funding limits. See Washington Code 71A.10.020 services: means services provided by state or local government to carry out this title. See Washington Code 71A.10.020 Vacancy: means an opening at a residential habilitation center, which when filled, would not require the center to exceed its biennially budgeted capacity.
