Terms Used In 5 Guam Code Ann. § 5450

  • Contract: A legal written agreement that becomes binding when signed.
The provisions of this Subarticle apply where it is determined administratively, or upon administrative or judicial review, that a solicitation or award of a contract is in violation of law.

COMMENT: This Subarticle applies only after a solicitation or award has been actually made or, in the case of an award, in such a stage as to be beyond the general scope of negotiation or review. It does not apply to, say, a review by the Attorney General, who determines, in the course of his normal review, that the proposed action would be in violation of law if it were to be made.
