Terms Used In 6 Guam Code Ann. § 7502
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
A trial or other proceeding must not be postponed by reason of depositions or interrogatories not returned, except upon evidence, satis- factory to the court, that the testimony of the witness is necessary and that proper diligence has been used to obtain it.
