the petition referred to in Section 3001(a) of this Title is made by the personal representative, the cost of the proceeding must be paid by the estate, excepting that when a partition is necessary the cost of the partition must be apportioned among the parties interested in the partition. If such petition is not made by the personal representative, the costs must be paid by the person making the petition, or if there are more than one, the costs must be apportioned among them.
