Each employer

(a) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees;

(b) shall comply with Occupational Safety and Health Standards promulgated under this Act, and all applicable rules issued thereunder.

Each employee shall comply with Occupational Safety and Health standards and all rules, regulations and orders issued pursuant to this Act which are applicable to his own actions and conduct.

§ 1205. Agency Responsible for Occupational Safety and
Health.

The Department is hereby designated as the agency of Guam responsible for developing and administering a plan in accordance with the provisions of §18(c) of said Act, and in accordance with any rules, regulations, standards, or guidelines relating to such plans promulgated or published by the United States Department of Labor pursuant to said Act. the Department is hereby vested with the authority to enter into an agreement with the United States Department of Labor which provides for interim enforcement of Occupational Safety and health Standards by Guam pursuant to §18(h) of said Act.
