South Carolina Code 9-9-65. Disability retirement allowance
(2) Upon retirement for disability on or after July 1, 1977, the member shall receive a retirement allowance determined in accordance with § 9-9-60 if he has attained the age of sixty years or completed thirty-five or more years of credited service. Otherwise, he shall receive a disability retirement allowance which shall be computed as the greater of (a) or (b) as follows:

- Board: means the Board of Directors of the South Carolina Public Employee Benefit Authority. See South Carolina Code 9-9-10
- Credited service: shall mean service for which credit is allowable as provided in § 9-9-50. See South Carolina Code 9-9-10
- Retirement allowance: shall mean monthly payments for life under the System payable as provided in § 9-9-80. See South Carolina Code 9-9-10
- State: shall mean the State of South Carolina. See South Carolina Code 9-9-10
- System: shall mean the Retirement System for members of the General Assembly of the State of South Carolina. See South Carolina Code 9-9-10
(a) An allowance equal to fifty percent of the retirement allowance which would have been payable in accordance with § 9-9-60 had he continued in service to the earlier of the age of sixty years or the completion of thirty-five years of credited service.
(b) An allowance determined in accordance with § 9-9-60 based on his credited service at the time of discontinuance of active service on account of disability.
