Terms Used In South Carolina Code 9-21-70
- Administrative Law Court: means the Administrative Law Court created pursuant to § 1-23-500. See South Carolina Code 9-21-20
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- Claimant: means a member or a member's designated beneficiary who has filed a claim pursuant to this chapter. See South Carolina Code 9-21-20
A claimant may appeal a final decision of the Administrative Law Court in a case brought pursuant to this chapter to the court of appeals pursuant to § 1-23-380 and the South Carolina Appellate Court Rules. If a claimant brings an action covered by this chapter in the court of common pleas, the court must dismiss the case without prejudice.
