Terms Used In South Carolina Code 40-8-190

  • Board: means the South Carolina Perpetual Care Cemetery Board. See South Carolina Code 40-8-30
  • Cemetery: means a place used, dedicated, or designated for cemetery purposes including any one or combination of:

    (a) perpetual care cemeteries;

    (b) burial parks for earth interment;

    (c) mausoleums;

    (d) columbariums. See South Carolina Code 40-8-30
  • Conviction: A judgement of guilt against a criminal defendant.
  • Person: means an individual, entity, corporation, partnership, joint venture, or association. See South Carolina Code 40-8-30
A person who operates a cemetery in this State in violation of this chapter or who knowingly submits false information to the board for the purpose of obtaining a license is guilty of a misdemeanor and, upon conviction, must be fined not less than two hundred fifty dollars or more than ten thousand dollars or imprisoned not less than thirty days or more than twelve months, or both.
