Terms Used In South Carolina Code 44-89-90

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Department: means the South Carolina Department of Health and Environmental Control. See South Carolina Code 44-89-30
Any applicant or licensee who is aggrieved with a final decision of the department as a result of the hearing provided for by § 44-85-80 may appeal to the appropriate court for judicial review pursuant to the Administrative Procedures Act.
