(A) An owner or operator of a childcare center, group childcare home, or family childcare home, as defined by § 63-13-20, must notify and obtain signed statements from the custodial parent or parents or guardian or guardians of each child currently enrolled in the childcare center, group childcare home, or family childcare home indicating that the parent or parents or guardian or guardians have received notice that the childcare center, group childcare home, or family childcare home may provisionally employ a person in order to comply with § 63-7-1980 and § 63-13-40(D) when an unexpected staff vacancy occurs. Provisional employment may only occur pursuant to the provisions of § 63-13-40(D).
(B) Within sixty days of this act’s effective date, an owner or operator of a childcare center, group childcare home, or family childcare home, as defined by § 63-13-20 of the 1976 Code, must notify and obtain signed statements pursuant to the provisions of this section from the custodial parent or parents or guardian or guardians of each child enrolled on this act’s effective date in the childcare center, group childcare home, or family childcare home.
Terms Used In South Carolina Code 63-13-45
- Child: means a person under the age of eighteen. See South Carolina Code 63-1-40
- family childcare home: means a facility within a residence occupied by the operator in which childcare regularly is provided for no more than six children, unattended by a parent or legal guardian, including those children living in the home and the children received for childcare who are related to the resident caregiver. See South Carolina Code 63-13-810
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Guardian: means a person who legally has the care and management of a child. See South Carolina Code 63-1-40
- Parent: means biological parent, adoptive parents, step-parent, or person with legal custody. See South Carolina Code 63-1-40
