I. The governor and council, on behalf of this state, are authorized to enter into agreements with the United States Nuclear Regulatory Commission or any successor thereto, pursuant to section 274(b) of the Atomic Energy Act of 1954, as amended, providing for discontinuance of certain of the commission’s licensing and related regulatory authority with respect to byproduct, source, and special nuclear materials and the assumption of regulatory authority by this state.
II. Any person who, on the effective date of an agreement under paragraph I, possesses a license issued by the United States Nuclear Regulatory Commission or any successor thereto for radioactive material subject to the agreement, shall be deemed to possess a like license issued under this chapter, which shall expire either 90 days after receipt from the program of a notice of expiration of such license, or on the date of expiration specified in the Nuclear Regulatory Commission license, whichever is earlier.

Terms Used In New Hampshire Revised Statutes 125-F:14

  • governor and council: shall mean the governor with the advice and consent of the council. See New Hampshire Revised Statutes 21:31-a
  • License: general and specific:
    (a) "General license" means a license pursuant to rules adopted by the program without the filing of an application with the program, or the issuance of licensing documents to particular persons to transfer, acquire, own, possess or use quantities of, or devices or equipment utilizing, radioactive material.   • Person: means any individual, corporation, partnership, firm, association, trust, estate, public or private institution, group, agency of this state other than the program, political subdivision of this state, any other state or political subdivision or agency, and any legal successor, representative, or agent of the foregoing, other than federal government agencies. See New Hampshire Revised Statutes 125-F:3
  • Program: means the radiological health program of the department of health and human services. See New Hampshire Revised Statutes 125-F:3
  • Radioactive material: means any material, whether solid, liquid, or gas, which emits radiation spontaneously. See New Hampshire Revised Statutes 125-F:3
  • state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4
  • United States: shall include said district and territories. See New Hampshire Revised Statutes 21:4
