Terms Used In New Hampshire Revised Statutes 264:1
- Accident: shall mean any event that results in injury or property damage attributable directly or indirectly to the motion of a motor vehicle or its load. See New Hampshire Revised Statutes 259:1-a
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Department: shall mean the department of safety of the state of New Hampshire. See New Hampshire Revised Statutes 259:19
- Director: shall mean the director of the division of motor vehicles of the department of safety. See New Hampshire Revised Statutes 259:20
- Person: shall mean the same as provided in N. See New Hampshire Revised Statutes 259:74
- petition: when used in connection with the equity jurisdiction of the superior court, and referring to a document filed with the court, shall mean complaint, and "petitioner" shall mean plaintiff. See New Hampshire Revised Statutes 21:51
- Plaintiff: The person who files the complaint in a civil lawsuit.
The director shall administer and enforce the provisions of this chapter, and he is authorized to adopt pursuant to N.H. Rev. Stat. § 260:5 and enforce such rules as may be necessary for its administration. Any person aggrieved by an order or act of the department hereunder may, within 10 days after notice thereof, file a petition for a review in the superior court of the county in which one of the parties resides, and if both plaintiff and defendant are nonresidents, then in the county where the accident occurred; but the filing of such petition shall not suspend the order or act unless a stay thereof shall be allowed by said court pending final determination of the review. The court shall summarily hear the petition and may make any appropriate order or decree.
