Terms Used In New Hampshire Revised Statutes 265:103
- Driver: shall mean a person who drives or is in actual physical control of a motor vehicle as defined in N. See New Hampshire Revised Statutes 259:25
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.

When any violation of N.H. Rev. Stat. § 265:102 has been observed by any person, and the matter disposed of has been ejected from a vehicle, such observation is prima facie evidence that the driver of such vehicle has committed the violation.
