Terms Used In New Hampshire Revised Statutes 339-A:4

  • commissioner: means the commissioner of the department of health and human services. See New Hampshire Revised Statutes 339-A:2
  • hazardous substance: means
    (a) Any substance or mixture of substances which is toxic, is corrosive, is an irritant, is a strong sensitizer, is flammable or generates pressure through decomposition, heat, or other means, if such substance or mixture of substances may cause substantial personal injury or substantial illness during or as a proximate result of any customary or reasonably foreseeable handling or use, including reasonably foreseeable ingestion by children;
    (b) Any substance which the commissioner by regulation finds, pursuant to the provisions of N. See New Hampshire Revised Statutes 339-A:2
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • United States: shall include said district and territories. See New Hampshire Revised Statutes 21:4
No person shall be subject to the penalties of N.H. Rev. Stat. § 339-A:7 for having violated paragraph I of N.H. Rev. Stat. § 339-A:1, if the receipt, delivery, or proffered delivery of a hazardous substance was made in good faith, unless he refuses to furnish on request of the commissioner or of an employee of the department of health and human services, the name and address of the person from whom he purchased or received such hazardous substance, and copies of all records, if any there be, pertaining to the delivery of the hazardous substance to him; or if he establishes a guarantee or undertaking signed by, and containing the name and address of, the person residing in the United States from whom he received in good faith the hazardous substance, to the effect that the hazardous substance is not in misbranded packages within the meaning of the terms of the chapter.
