I. Institution of an action under N.H. Rev. Stat. § 356:4-a to assess a civil penalty against a person shall preclude the institution of criminal proceedings under N.H. Rev. Stat. § 356:4 against that person for the conduct alleged in the civil action.
II. Institution of criminal prosecution against a person under N.H. Rev. Stat. § 356:4 shall preclude the institution of civil proceedings under N.H. Rev. Stat. § 356:4-a against that person for the conduct specified in the information or indictment.

Terms Used In New Hampshire Revised Statutes 356:4-d
- Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
