I. The commissioner, in consultation with the commissioner of health and human services, shall adopt primary and secondary drinking water standards pursuant to N.H. Rev. Stat. § 485:3, and ambient groundwater quality standards pursuant to N.H. Rev. Stat. § 485-C:6, applicable to MTBE. The commissioner shall not commence rulemaking for these standards until after the department has reviewed the scientific record on the risks posed by the presence of MTBE in drinking water supplies. Such review shall be completed at the earliest possible date, but no later than January 1, 2000. The commissioner shall commence rulemaking no later than January 1, 2000.
II. Any public water system delivering water with greater than 5 parts per billion of MTBE shall notify each customer of the MTBE content.
