Terms Used In New Hampshire Revised Statutes 596-A:10
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
The accused shall not be called upon to plead, if the offense is beyond the jurisdiction of the court to decide. If the accused waives preliminary examination thereof, the court shall hold the accused to appear in superior court as provided in N.H. Rev. Stat. § 596-A:13. If the accused does not waive preliminary examination, the court shall hear the evidence within a reasonable time. The accused may cross-examine the witnesses against them and may introduce evidence in their own behalf.
