Terms Used In West Virginia Code > Chapter 21A > Article 6A - Extended Benefits Program

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Balanced budget: A budget in which receipts equal outlays.
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Exhaustee: means an individual who, with respect to any week of unemployment in his or her eligibility period:

    (A) Has received, prior to such week, all of the regular benefits which were available to him or her under this chapter or any other state law (including dependents'. See West Virginia Code 21A-6A-1

  • Extended benefit period: means a period which:

    (A) Begins with the third week after a week for which there is a state "on" indicator. See West Virginia Code 21A-6A-1

  • Extended benefits: means benefits (including benefits payable to federal civilian employees and to ex-servicemen pursuant to 5 U. See West Virginia Code 21A-6A-1
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • in writing: includes any representation of words, letters, or figures, whether by printing, engraving, writing, or otherwise. See West Virginia Code 2-2-10
  • Rate of insured unemployment: means the percentage derived by dividing:

    (A) The average weekly number of individuals filing claims for regular compensation in this state for weeks of unemployment with respect to the most recent thirteen-consecutive-week period as determined by the commissioner on the basis of his or her reports to the United States Secretary of Labor. See West Virginia Code 21A-6A-1

  • Regular benefits: means benefits payable to an individual under this chapter or under any other state law (including benefits payable to federal civilian employees and to ex-servicemen pursuant to 5 U. See West Virginia Code 21A-6A-1
  • State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
  • State law: means the unemployment insurance law of any state, approved by the United States Secretary of Labor under 26 U. See West Virginia Code 21A-6A-1
  • suitable work: means , with respect to any individual, any work which is within such individual'. See West Virginia Code 21A-6A-1
