The period of limitation applicable to a claim accruing outside of this state shall be either that prescribed by the law of the place where the claim accrued or by the law of this state, whichever bars the claim.

Terms Used In West Virginia Code 55-2A-2

  • claim: means any right of action which may be asserted in a civil action or proceeding and includes, but is not limited to, a right of action created by statute. See West Virginia Code 55-2A-1
  • State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
