Access: means to gain logical entry into, instruct, communicate with, store data in or retrieve data from any computer resource. See Maine Revised Statutes Title 17-A Sec. 431
Acquittal:
1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
2. A verdict of "not guilty."
Adjudication: means a finding by a court that a person has committed a traffic infraction and includes the acceptance by the clerk of the violations bureau or any judicial division of an answer of not contested. See Maine Revised Statutes Title 29-A Sec. 101
Adjusted gross sports wagering receipts: means an operator's gross receipts from sports wagering less the total of all winnings paid to patrons, which includes the cash equivalent of any merchandise or thing of value awarded as a prize, and less excise tax payments remitted to the Federal Government. See Maine Revised Statutes Title 8 Sec. 1202
administration of criminal justice: means activities relating to the investigation of all or specific crimes and the prosecution of offenders. See Maine Revised Statutes Title 17-A Sec. 431
Adult: means a person who has attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72
Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
Agent: means a principal corporate officer, partner, owner or majority shareholder of a contract security company or a resident of the State who manages or supervises the security guard business of a resident or nonresident contract security company within the State. Agent: means an individual appointed to serve in the capacity of a superintendent. See Maine Revised Statutes Title 20-A Sec. 1
Alcohol and drug program: means the alcohol and other drug education, evaluation and treatment program administered by the Department of Health and Human Services under Title 5, chapter 521, subchapter 5. See Maine Revised Statutes Title 29-A Sec. 2401
Alcohol level: means either grams of alcohol per 100 milliliters of blood or grams of alcohol per 210 liters of breath. See Maine Revised Statutes Title 29-A Sec. 2401
Alcohol-related or other drug-related motor vehicle incident: means a conviction or administrative action resulting in the suspension of a motor vehicle operator's license for a violation under former Title 29, section 1311-A; Title 29, section 1312, subsection 10?A; Title 29, section 1312?C; Title 29, section 1312?B; Title 29, section 1313?B; Title 29, section 2241, subsection 1, paragraph N; Title 29, section 2241?G, subsection 2, paragraph B, subparagraph (2); Title 29, section 2241-J; Title 29?A, section 1253; Title 29?A, section 2411; Title 29?A, section 2453; Title 29?A, section 2454, subsection 2; Title 29?A, section 2456; Title 29?A, section 2457; Title 29?A, section 2472, subsection 3, paragraph B and subsection 4; Title 29?A, section 2503; Title 29?A, sections 2521 and 2523; or Title 29?A, section 2525 or the rules adopted by the Department of the Secretary of State for the suspension of commercial drivers' licenses. Allegation: something that someone says happened.
Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
Amusement owner: means a person, the State or a political subdivision of the State that owns an amusement ride or, if the amusement ride is leased, the lessee. See Maine Revised Statutes Title 8 Sec. 802
Amusement ride: means :

Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.

Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.

Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

Appraisal: A determination of property value.

Appraisal assignment: means an agreement between an appraiser and an appraisal management company to provide an appraisal service. See Maine Revised Statutes Title 32 Sec. 14042

Appraisal management company: means a person that:

Appraisal review: means the act or process of developing and communicating an opinion about the quality of the work performed by an appraiser as part of an appraisal assignment, which may take into account the appraiser's data collection, analysis, opinions, conclusions, estimate of value or compliance with the Uniform Standards of Professional Appraisal Practice. See Maine Revised Statutes Title 32 Sec. 14042

Appraisal service: means an act or process of completing an appraisal assignment. See Maine Revised Statutes Title 32 Sec. 14042

Appraiser: means a person licensed under chapter 124. See Maine Revised Statutes Title 32 Sec. 14042

Appraiser panel: includes appraisers accepted by an appraisal management company for consideration for future appraisal assignments in covered transactions or for secondary mortgage market participants in connection with covered transactions and appraisers engaged by an appraisal management company to perform one or more appraisals in covered transactions or for secondary mortgage market participants in connection with covered transactions. See Maine Revised Statutes Title 32 Sec. 14042

Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization

Approved public treatment facility: means an alcohol treatment facility operating under the direction and control of the department or providing treatment under this subchapter through a contract with the department under section 20008, or any facility funded in whole or in part by municipal, state or federal funds. See Maine Revised Statutes Title 5 Sec. 20003

Approved treatment facility: means a public or private alcohol treatment facility meeting standards approved by the department in accordance with section 20005 and licensed pursuant to subchapter 5 and other applicable provisions of state law. See Maine Revised Statutes Title 5 Sec. 20003

Arborist: means a person who, for compensation, takes down or fells, diagnoses or evaluates the condition of shade or ornamental trees; solicits, recommends or supervises the treatment of those trees; or in any manner or for any purpose treats or cares for those trees. See Maine Revised Statutes Title 7 Sec. 2173

Armored car service: means the service provided by any person transporting or offering to transport, under armed security guard, currency, jewels, stocks, bonds, paintings or other things of value in a motor vehicle specially equipped to offer a high degree of security. See Maine Revised Statutes Title 32 Sec. 9403

Arrest: Taking physical custody of a person by lawful authority.

Article: means a product as distinguished from its trademark, label or distinctive dress in packaging;

Assessment: means selecting, administering and interpreting instruments designed to assess personal, interpersonal and group characteristics. See Maine Revised Statutes Title 32 Sec. 13851

Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.

Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.

Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.

Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.

Beginner fantasy contestant: means an individual who has entered fewer than 51 fantasy contests offered by a single fantasy contest operator. See Maine Revised Statutes Title 8 Sec. 1101

Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. ^{Source: OCC}

Bequest: Property gifted by will.

Board: means the Board of Licensure of Professional Investigators under section 8103?A, as established under Title 5, section 12004?G, subsection 29?D. See Maine Revised Statutes Title 32 Sec. 8103

Board: means the Board of Respiratory Care Practitioners established under this chapter. See Maine Revised Statutes Title 32 Sec. 9702

Board: means the Radiologic Technology Board of Examiners. See Maine Revised Statutes Title 32 Sec. 9852

Board: means the Board of Licensing of Dietetic Practice established under this chapter. See Maine Revised Statutes Title 32 Sec. 9902

Board: means the Board of Underground Oil Storage Tank Installers established under this chapter. See Maine Revised Statutes Title 32 Sec. 10002

Board: means the Board of Counseling Professionals Licensure, established in section 13852. See Maine Revised Statutes Title 32 Sec. 13851

Board: means the Board of Real Estate Appraisers under section 14011. See Maine Revised Statutes Title 32 Sec. 14042

Board of directors: means the governing body with statutory powers and duties for a school administrative district. See Maine Revised Statutes Title 20-A Sec. 1

board of directors: means the directors of the jail authority. See Maine Revised Statutes Title 30-A Sec. 1802

Bonds: means bonds of the bank issued under this chapter. See Maine Revised Statutes Title 30-A Sec. 5903

Bureau: means the Bureau of Motor Vehicles. See Maine Revised Statutes Title 29-A Sec. 101

Bus: means a motor vehicle designed for carrying more than 15 persons, including the operator. See Maine Revised Statutes Title 29-A Sec. 101

Capital reserve fund: means any capital reserve fund created or established as provided in section 6006, subsection 1?A. See Maine Revised Statutes Title 30-A Sec. 5903

Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.

Certification mark: means a mark used in connection with the goods or services of a person other than the certifier to indicate geographic origin, material, mode of manufacture, quality, accuracy or other characteristics of the goods or services or to indicate that the work or labor on the goods or services was performed by members of a union or other organization;

certified seed: as used in this Title shall be deemed to mean potato, vegetable, forage crop or grain seeds as shall have been grown and prepared for sale in accordance with regulations laid down by the commissioner and for which a certificate or tag has been issued as provided in section 2103. See Maine Revised Statutes Title 7 Sec. 2101

Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.

Chief: means the Chief of the State Police or the chief's designee. See Maine Revised Statutes Title 32 Sec. 8103

Chief administrative officer: means the head of a correctional facility or a detention facility. See Maine Revised Statutes Title 34-A Sec. 1001

Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.

Civil forfeiture: The loss of ownership of property used to conduct illegal activity.

Class I liquid: means any liquid having a flash point below 100° Fahrenheit. See Maine Revised Statutes Title 32 Sec. 10002

Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.

Client: means a person that contracts with or otherwise enters into an agreement with an appraisal management company for the performance of appraisal management services. See Maine Revised Statutes Title 32 Sec. 14042

Client: means a person who is required to complete an alcohol and other drug education, evaluation and treatment program for an alcohol-related or drug-related motor vehicle offense. See Maine Revised Statutes Title 5 Sec. 20071

Client company: means a person, association, partnership, corporation or other entity that leases employees from an employee leasing company pursuant to contract. See Maine Revised Statutes Title 32 Sec. 14051

Clinical professional counselor: means a professional counselor who renders or offers to render for a fee, monetary or otherwise, to individuals, families, groups, organizations or the general public, a counseling service involving the application of the principles and procedures of counseling to assess and treat intrapersonal and interpersonal problems and other dysfunctional behaviors and to assist in the overall development and adjustment of those served. See Maine Revised Statutes Title 32 Sec. 13851

Collective mark: means a mark used by members of a cooperative, association or other collective group or organization to identify goods or services and distinguish them from those of others, or to indicate membership in the collective group or organization;

Collegiate sports or athletic event: means a sports or athletic event offered or sponsored by, or played in connection with, a public or private institution that offers postsecondary educational services. See Maine Revised Statutes Title 8 Sec. 1202

Commercial motor vehicle: means a motor vehicle or combination of motor vehicles used in commerce to transport passengers or property if the motor vehicle:

Commission: means the Substance Use Disorder Services Commission, as established by section 12004?G, subsection 13?C. See Maine Revised Statutes Title 5 Sec. 20003

Commissioner: means the Commissioner of Public Safety. See Maine Revised Statutes Title 8 Sec. 1202

Commissioner: means the Commissioner of Public Safety. See Maine Revised Statutes Title 32 Sec. 9403

Commissioner: means the Commissioner of Professional and Financial Regulation. See Maine Revised Statutes Title 32 Sec. 9702

Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.

Community service provider: means a provider of substance use disorder treatment or gambling addiction treatment, including, but not limited to, evaluation. See Maine Revised Statutes Title 5 Sec. 20003

Community-based service provider: means a provider of either the treatment component or the evaluation component, or both, of the alcohol and other drug education, evaluation and treatment program certified under section 20075 or a program approved by the office. See Maine Revised Statutes Title 5 Sec. 20071

Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.

Computer: means an electronic, magnetic, optical, electrochemical or other high-speed data processing device performing logical, arithmetic or storage functions and includes any data storage device or communications facility directly related to or operating in conjunction with the device. See Maine Revised Statutes Title 17-A Sec. 431

Computer forensics: means the use of digital forensic science that involves the examination of digital media to identify, preserve, recover and analyze information related to legal matters. See Maine Revised Statutes Title 32 Sec. 8103

Computer information: means a representation of information, knowledge, facts, concepts or instructions that are confidential or proprietary, are being prepared or have been prepared from an organized set of data and are located in computer memory or on magnetic, optical or mechanical media transferable directly to or useable directly by a computer as a source of data or instructions. See Maine Revised Statutes Title 17-A Sec. 431

Computer network: means a combination of one or more computers and communication facilities with the capability to transmit information among the devices or computers. See Maine Revised Statutes Title 17-A Sec. 431

Computer program: means an ordered set of data representing coded instructions or statements that, when executed by a computer, cause the computer to process data. See Maine Revised Statutes Title 17-A Sec. 431

Computer resource: means a computer program, computer software, computer system, computer network, computer information or any combination thereof. See Maine Revised Statutes Title 17-A Sec. 431

Computer software: means a set of computer programs, procedures and associated documentation used in the operation of a computer system. See Maine Revised Statutes Title 17-A Sec. 431

Computer system: means any combination of a computer or computers with the documentation, computer software or physical facilities supporting the computer. See Maine Revised Statutes Title 17-A Sec. 431

Computer virus: means any computer instruction, information, data or program that degrades the performance of a computer resource; disables, damages or destroys a computer resource; or attaches itself to another computer resource and executes when the host computer program, data or instruction is executed or when some other event takes place in the host computer resource, data or instruction. See Maine Revised Statutes Title 17-A Sec. 431

Conditional license: means a license granted to an applicant for licensure who has met all the requirements defined in section 13858, except for supervised experience. See Maine Revised Statutes Title 32 Sec. 13851

Consent of county: means a vote taken pursuant to section 122 or a vote taken at an election at which a majority of the legal votes of the voters of a county voting at the election are cast in favor of a question seeking approval of funding construction of a jail facility through the issuance of bonds or the guarantee by the counties of bonds issued by the jail authority. See Maine Revised Statutes Title 30-A Sec. 1802

Consumer: means a natural person who purchases or contracts to purchase consumer goods. See Maine Revised Statutes Title 10 Sec. 1231

Consumer credit: means credit offered or extended to a consumer primarily for personal, family or household purposes. See Maine Revised Statutes Title 32 Sec. 14042

Consumer goods: means any objects, wares, commodities or services offered for sale and intended to be used by consumers for personal, family or household purposes. See Maine Revised Statutes Title 10 Sec. 1231

Consumer pack: means a unit of 50 pounds or less net weight of potatoes contained in a bag or other type of container. See Maine Revised Statutes Title 7 Sec. 1032

Continuance: Putting off of a hearing ot trial until a later time.

Contract: A legal written agreement that becomes binding when signed.

Contract security company: means any person engaged in the business of providing, or who undertakes to provide, a security guard for another person. See Maine Revised Statutes Title 32 Sec. 9403

Controlling person: means :

A. See Maine Revised Statutes Title 32 Sec. 14042

Conversion therapy: means any practice or treatment that seeks or claims to change an individual's sexual orientation or gender identity, including, but not limited to, any effort to change gender expression or to eliminate or reduce sexual or romantic attractions, feelings or behavior toward others based on the individual's gender. See Maine Revised Statutes Title 32 Sec. 59-C

Conviction: A judgement of guilt against a criminal defendant.

Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.

Correctional facility: means any facility that falls under the jurisdiction of the department, but does not include any facility for which the department is required to establish standards pursuant to section 1208 or 1208?A. See Maine Revised Statutes Title 34-A Sec. 1001

Corrections officer: means a person who is responsible for the custody or direct supervision of a person confined in a jail, prison or state correctional facility pursuant to an order of a court or as a result of an arrest and who possesses a current and valid certificate issued by the Board of Trustees of the Maine Criminal Justice Academy pursuant to Title 25, section 2803?A. See Maine Revised Statutes Title 30-A Sec. 1581

Counseling: means assisting individuals, families or groups through the counseling relationship to develop understanding of intrapersonal and interpersonal problems, to define goals, to make decisions, to plan a course of action reflecting their needs, and to use information and community resources, as these procedures are related to personal, social, educational and vocational development. See Maine Revised Statutes Title 32 Sec. 13851

Counselor: means an individual who for a fee, monetary or otherwise, engages in any of the procedures of counseling defined in subsection 8. See Maine Revised Statutes Title 32 Sec. 13851

Counterclaim: A claim that a defendant makes against a plaintiff.

County: means either Lincoln County or Sagadahoc County, and "counties" means both Lincoln County and Sagadahoc County. See Maine Revised Statutes Title 30-A Sec. 1802

County commissioners: means the county commissioners in a county or the officers, under a charter, who exercise legislative powers within the county. See Maine Revised Statutes Title 30-A Sec. 1302

County legislative delegation: means all state legislators whose legislative districts, in whole or in part, lie within the boundaries of a county. See Maine Revised Statutes Title 30-A Sec. 1

County officers: means the commissioners, treasurer, sheriff, register of deeds and register of probate of a county. See Maine Revised Statutes Title 30-A Sec. 1

County official: means an elected or appointed member of a county government. See Maine Revised Statutes Title 30-A Sec. 1

Covered transaction: means a consumer credit transaction secured by a consumer's principal dwelling. See Maine Revised Statutes Title 32 Sec. 14042

Creditor: means a person who regularly extends consumer credit that is subject to a finance charge or is payable by written agreement in more than 4 installments, not including a down payment, and to whom the obligation is initially payable, either on the face of the note or contract or by agreement when there is no note or contract. See Maine Revised Statutes Title 32 Sec. 14042

Criminal justice agency: includes the Department of the Attorney General and district attorneys' offices. See Maine Revised Statutes Title 17-A Sec. 431

Custodian: means the person having care and custody over the individual seeking sterilization or the individual for whom sterilization is sought. See Maine Revised Statutes Title 34-B Sec. 7003

Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.

Dangerous substance: means alcohol or any substance that is a schedule W, X, Y or Z drug under Title 17?A, chapter 45. See Maine Revised Statutes Title 32 Sec. 9403

Data storage device: means any computer or accessory device, designed for or capable of storing digital media or data, including, but not limited to, installed or transportable hard drives, memory cards and servers. See Maine Revised Statutes Title 17-A Sec. 431

Decedent: A deceased person.

Deed: The legal instrument used to transfer title in real property from one person to another.

Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

Dental radiographer: means a person, other than a licensed practitioner, whose duties include radiography of the maxilla, mandible and adjacent structures for diagnostic purposes and who is licensed under chapter 143. See Maine Revised Statutes Title 32 Sec. 9852

Department: means the Department of Transportation. See Maine Revised Statutes Title 29-A Sec. 101

Department: means the Department of Public Safety. See Maine Revised Statutes Title 8 Sec. 1202

Department: means the Department of Professional and Financial Regulation. See Maine Revised Statutes Title 32 Sec. 9702

Department: means the Department of Professional and Financial Regulation. See Maine Revised Statutes Title 32 Sec. 9902

Department: means the Department of Environmental Protection. See Maine Revised Statutes Title 32 Sec. 10002

Dependency-related drug: means alcohol or any substance controlled under Title 22, chapter 558 or Title 32, chapter 117. See Maine Revised Statutes Title 5 Sec. 20003

Dependent: A person dependent for support upon another.

Designated family member: means the spouse, child, grandchild, parent or sibling of the owner of a new personal sports mobile dealership who in the case of the owner's death is entitled to inherit the ownership interest in the new personal sports mobile dealership under the terms of the owner's will or who in the case of an incapacitated owner of a new personal sports mobile dealership has been appointed by a court as the legal representative of the new personal sports mobile dealer's property. Detention facility: means the Long Creek Youth Development Center. See Maine Revised Statutes Title 34-A Sec. 1001

Dietetics: means the professional discipline of assessing the nutritional needs of an individual, including recognition of the effects of the individual's physical condition and economic circumstances, and the applying of scientific principles of nutrition to prescribing means to ensure the individual's proper nourishment and care. See Maine Revised Statutes Title 32 Sec. 9902

Director: means the director of the Gambling Control Unit within the Department of Public Safety. See Maine Revised Statutes Title 8 Sec. 1101

Director: means the director of the Gambling Control Unit within the department. See Maine Revised Statutes Title 8 Sec. 1202

Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.

Disinterested expert: means an appropriately licensed or certified professional not associated with an institution serving the person for whom sterilization is being sought and not personally related to the petitioner. See Maine Revised Statutes Title 34-B Sec. 7003

Distributor branch: means a branch office maintained by a distributor or wholesaler that sells or distributes new or used personal sports mobiles to personal sports mobile dealers. See Maine Revised Statutes Title 10 Sec. 1242

Distributor representative: means a representative employed by a distributor branch, distributor or wholesaler. See Maine Revised Statutes Title 10 Sec. 1242

Docket: A log containing brief entries of court proceedings.

Domestic partner: means one of 2 unmarried adults who are domiciled together under long-term arrangements that evidence a commitment to remain responsible indefinitely for each other's welfare. See Maine Revised Statutes Title 1 Sec. 72

Donor: The person who makes a gift.

Downtown: means :

Drug user: means a person who uses any dangerous substance in violation of any law of the State. See Maine Revised Statutes Title 32 Sec. 9403

Drug user: means a person who uses any drugs, dependency-related drugs or hallucinogens in violation of any law of the State. See Maine Revised Statutes Title 5 Sec. 20003

Drug-dependent person: means a person who is unable to function effectively and whose inability to do so results from the use of a dangerous substance. See Maine Revised Statutes Title 32 Sec. 9403

drugs: includes any natural or artificial chemical substance that, when taken into the human body, can impair the ability of the person to safely operate a motor vehicle. See Maine Revised Statutes Title 29-A Sec. 2401

Dwelling: includes an individual condominium unit, cooperative unit, mobile home and trailer, if it is used as a residence. See Maine Revised Statutes Title 32 Sec. 14042

Elementary school: means that portion of a school that provides instruction in any combination of kindergarten through grade 8. See Maine Revised Statutes Title 20-A Sec. 1

Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. ^{Source: OCC}

Employee: means a natural person who performs one or more security guard functions under a contract of hire between the natural person and a contract security company or between the natural person and a proprietary security organization. See Maine Revised Statutes Title 32 Sec. 9403

Employee leasing company: means a sole proprietorship, partnership, corporation or other form of business entity, a substantial portion of the business of which consists of leasing employees to one or more client companies under contractual arrangements that are characterized by the following. See Maine Revised Statutes Title 32 Sec. 14051

Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.

Entry fee: means cash or a cash equivalent that is required to be paid by a fantasy contestant to a fantasy contest operator in order to participate in a fantasy contest. See Maine Revised Statutes Title 8 Sec. 1101

Equipment purchases: means the purchase of new or updated equipment and any capital improvements necessary to use the new or updated equipment by career and technical education centers or career and technical education regions. See Maine Revised Statutes Title 30-A Sec. 5903

Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. Escrow: Money given to a third party to be held for payment until certain conditions are met.

Established business relationship: means a prior or existing relationship formed by a voluntary 2-way communication between a seller and a consumer with an exchange of consideration on the basis of the consumer's purchase from or transaction with the seller within the 18 months immediately preceding the date of a free offer. Ex officio: Literally, by virtue of one's office.

Executor: A male person named in a will to carry out the decedent

Facility operator: means a facility sports wagering licensee under subsection 7, paragraph A. See Maine Revised Statutes Title 8 Sec. 1202

Factory branch: means a branch maintained by a manufacturer that manufactures or assembles personal sports mobiles for sale to distributors or personal sports mobile dealers or that is maintained for directing and supervising the representatives of the manufacturer. See Maine Revised Statutes Title 10 Sec. 1242

Factory representative: means a representative employed by a manufacturer or employed by a factory branch for the purpose of making or promoting the sale of personal sports mobiles or for contracting with, supervising, servicing or instructing personal sports mobile dealers or prospective personal sports mobile dealers. See Maine Revised Statutes Title 10 Sec. 1242

failed to submit to a test: means failure to comply with the duty to submit to and complete a chemical test under section 2521 or 2525. See Maine Revised Statutes Title 29-A Sec. 2401

Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.

Fantasy contest: means a simulated game or contest in which:

Fantasy contest operator: means a person that offers a platform for the playing of fantasy contests and that administers a fantasy contest for which a prize of value is awarded. See Maine Revised Statutes Title 8 Sec. 1101

Fantasy contestant: means an individual who participates in a fantasy contest offered by a fantasy contest operator. See Maine Revised Statutes Title 8 Sec. 1101

Federal appraisal subcommittee: means the Appraisal Subcommittee of the Federal Financial Institutions Examination Council under 12 United States Code, Chapter 34. See Maine Revised Statutes Title 32 Sec. 14042

Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. ^{Source: OCC}

Federal financial institutions regulatory agency: means the federal Office of the Inspector General, Consumer Financial Protection Bureau, Federal Housing Finance Agency or Board of Governors of the Federal Reserve System; the Federal Deposit Insurance Corporation; the Office of the Comptroller of the Currency; or the National Credit Union Administration. See Maine Revised Statutes Title 32 Sec. 14042

Federal Government: means the United States of America or any agency or instrumentality, corporate or otherwise, of the United States of America. See Maine Revised Statutes Title 30-A Sec. 2001

Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. ^{Source: OCC}

Federally regulated appraisal management company: means an appraisal management company that is owned and controlled by an insured depository institution, as defined in 12 United States Code § 1813 and regulated by the federal Office of the Comptroller of the Currency; Office of the Inspector General, Board of Governors of the Federal Reserve System; or the Federal Deposit Insurance Corporation. See Maine Revised Statutes Title 32 Sec. 14042

Federally related transaction regulations: means regulations established by a federal financial institutions regulatory agency pursuant to Title XI, Sections 1112, 1113 and 1114 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989, 12 United States Code §§ 3341 to 3343. See Maine Revised Statutes Title 32 Sec. 14042

Fiduciary: A trustee, executor, or administrator.

Finance charge: The total cost of credit a customer must pay on a consumer loan, including interest. The Truth in Lending Act requires disclosure of the finance charge. ^{Source: OCC}

First offender: means a client who has no previous alcohol-related or drug-related motor vehicle incident within a 10-year period. See Maine Revised Statutes Title 5 Sec. 20071

Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.

Formal charging instrument: means a complaint, indictment, information, juvenile petition or other formal written accusation against a person for some criminal or juvenile offense. See Maine Revised Statutes Title 32 Sec. 9403

Franchisee: means a personal sports mobile dealer to whom a franchise is offered or granted. See Maine Revised Statutes Title 10 Sec. 1242

Franchisor: means a manufacturer, distributor or wholesaler who grants a franchise to a personal sports mobile dealer. See Maine Revised Statutes Title 10 Sec. 1242

Fraud: Intentional deception resulting in injury to another.

Free offer: means an offer of a rebate or of products or services without cost to a consumer by a seller under which, as a result of accepting the rebate, products or services, the consumer is required to contact the seller to avoid incurring a financial obligation for receiving additional products or services. See Maine Revised Statutes Title 10 Sec. 1210

Fully marketable form: means a municipal security duly executed and accompanied by an approving legal opinion of a bond counsel of recognized standing in the field of municipal law whose opinions are generally accepted by purchasers of municipal bonds, provided that the municipal security so executed need not be printed or lithographed nor be in more than one denomination. Funded debt: means an obligation for the payment of which some fund is set aside. See Maine Revised Statutes Title 30-A Sec. 2001

Gasoline: means a volatile, highly flammable liquid with a flashpoint of less than 100° Fahrenheit obtained from the fractional distillation of petroleum. See Maine Revised Statutes Title 32 Sec. 10002

General fund: means the fund created or established as provided in section 6007. See Maine Revised Statutes Title 30-A Sec. 5903

Germane: On the subject of the pending bill or other business; a strict standard of relevance.

Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.

Good faith: means honesty in fact and the observation of reasonable commercial standards of fair dealing in the trade. See Maine Revised Statutes Title 10 Sec. 1242

Governmental unit: means any county, municipality, school administrative district, community school district, public waste disposal corporation as authorized under Title 38, section 1304?B or other quasi-municipal corporation within the State, including any corporation owned entirely by a municipality and providing water, sewer or electric service or performing other essential governmental functions. Gross fantasy contest revenues: means the amount determined by subtracting the total of all sums paid out by a fantasy contest operator as cash prizes to all fantasy contestants from the total of all entry fees that the fantasy contest operator collects from all fantasy contestants and multiplying the result by the resident percentage. Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.

Ignition interlock device: means a device that connects a breath analyzer to a motor vehicle's ignition system. See Maine Revised Statutes Title 29-A Sec. 2401

Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. ^{Source: FDIC}

Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.

Informed consent: means consent that is:

Integrated medication-assisted treatment: means a treatment method that combines medication approved by the federal Food and Drug Administration for the treatment of substance use disorder with counseling, urine drug screening and behavioral therapy that has proven effective in treating substance use disorder. Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.

Investigative assistant: means a person who acts as a professional investigator under the supervision of a licensed professional investigator in accordance with this chapter. See Maine Revised Statutes Title 32 Sec. 8103

Ionizing radiation: means gamma rays and x rays; alpha and beta particles, high-speed electrons, neutrons, protons and other nuclear particles; but not ultrasound, sound or radio waves, magnetic fields or visible, infrared or ultraviolet light. See Maine Revised Statutes Title 32 Sec. 9852

Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.

jail: means any land area, structure, location or equipment, or combination of them, used for the confinement of prisoners. See Maine Revised Statutes Title 30-A Sec. 1802

jail authority: means the authority formed under this chapter and Title 13, chapter 81. See Maine Revised Statutes Title 30-A Sec. 1802

Juror: A person who is on the jury.

Kindergarten: means a one-year or 2-year childhood education program, for children at least 5 years of age, immediately prior to grade one. See Maine Revised Statutes Title 20-A Sec. 1

Labor: means the period of time before a birth during which contractions are of sufficient frequency, intensity and duration to bring about effacement and progressive dilation of the cervix. See Maine Revised Statutes Title 30-A Sec. 1581

lands: includes lands and all tenements and hereditaments connected therewith, and all rights thereto and interests therein. See Maine Revised Statutes Title 1 Sec. 72

Law enforcement officer: means a person who by virtue of public employment is vested by law with a duty to maintain public order or to make arrests for crimes, whether that duty extends to all crimes or is limited to specific crimes. See Maine Revised Statutes Title 29-A Sec. 101

Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). ^{Source: OCC}

Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).

Levels of care: means the continuum of recovery-oriented services that reflect an individual's risks, needs, strengths, resources and skills as determined by an assessment with standardized placement criteria conducted by a qualified clinician. See Maine Revised Statutes Title 5 Sec. 20003

License: includes , but is not limited to, a nonresident operating privilege and the privilege of a person to apply for or obtain a license or permit to operate a motor vehicle. See Maine Revised Statutes Title 29-A Sec. 101

License: means any license applied for or issued by the director under this chapter, including, but not limited to:

Licensed dietitian: means a person who practices dietetics and who is licensed as a dietitian under this chapter. See Maine Revised Statutes Title 32 Sec. 9902

Licensed physician: means a person licensed to practice medicine or osteopathy in this State. See Maine Revised Statutes Title 32 Sec. 9852

Licensed practitioner: means a person licensed to practice medicine, dentistry, chiropractic, podiatry or osteopathy in this State. See Maine Revised Statutes Title 32 Sec. 9852

Licensee: means any person licensed under this chapter as a professional investigator or investigative assistant. See Maine Revised Statutes Title 32 Sec. 8103

Licensee: means any person to whom a license is granted in accordance with this chapter. See Maine Revised Statutes Title 32 Sec. 9403

Licensee: means any person who holds an unrevoked and valid unsuspended license issued under this Article. See Maine Revised Statutes Title 7 Sec. 1012

Licensing authority: means the Commissioner of Public Safety. See Maine Revised Statutes Title 32 Sec. 9403

Lien: A claim against real or personal property in satisfaction of a debt.

Maine bag: means any consumer pack for potatoes on which appears the word Maine in letters larger than 1/4 inch or a pictorial representation of the outline of the shape of the state. See Maine Revised Statutes Title 7 Sec. 1032

Maine bag grade: means any of the officially established grades of potatoes as adopted by the commissioner. See Maine Revised Statutes Title 7 Sec. 1032

manufacturer: includes the terms "franchisor" "distributor" "distributor branch" "wholesaler" "factory branch" and "factory representative. See Maine Revised Statutes Title 10 Sec. 1242

Manufacturer rebate: means any offer or promise that a manufacturer or distributor will refund to a consumer all or a portion of the price paid by the consumer for the purchase of consumer goods. See Maine Revised Statutes Title 10 Sec. 1231

Marital and family therapy services: means the assessment and treatment of intrapersonal and interpersonal problems through the application of principles, methods and therapeutic techniques for the purpose of resolving emotional conflicts, modifying perceptions and behavior, enhancing communication and understanding among all family members, and preventing family and individual crises. Marital deduction: The deduction(s) that can be taken in the determination of gift and estate tax liabilities because of the existence of a marriage or marital relationship.

Mark: means a word, name, symbol, device or any combination of the foregoing in any form or arrangement;

Membership: means active participation in the program of a school from the date of enrollment to the time the student withdraws or is absent from the school for 10 consecutive days for reasons other than illness. See Maine Revised Statutes Title 20-A Sec. 15001

Minor: means a person who has not attained 18 years of age. See Maine Revised Statutes Title 17-A Sec. 281

Mobile operator: means a mobile sports wagering licensee under subsection 7, paragraph B. See Maine Revised Statutes Title 8 Sec. 1202

Month: means a calendar month. See Maine Revised Statutes Title 1 Sec. 72

Mortgage: The written agreement pledging property to a creditor as collateral for a loan.

Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
