Terms Used In Maine Revised Statutes Title 24 Sec. 2309
- Contract: A legal written agreement that becomes binding when signed.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- superintendent: means the Superintendent of Insurance of this State; and
Any dispute arising between a corporation subject to this chapter and any provider of health care with which such corporation has a contract for health care may be submitted to the superintendent for the superintendent’s decision with respect thereto. Any decision and findings of the superintendent made under this chapter are not a bar to constituted legal procedure for the review of such proceedings in a court of competent jurisdiction.
