Terms Used In Maine Revised Statutes Title 12 Sec. 549

  • Development: means all of the methods used in the preparation of a known and presumed economically extractable ore deposit for mining. See Maine Revised Statutes Title 12 Sec. 549-A
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • lands: includes lands and all tenements and hereditaments connected therewith, and all rights thereto and interests therein. See Maine Revised Statutes Title 1 Sec. 72
  • Mining: means all of the extractive and beneficiative processes necessary to remove and prepare a mineral deposit for market. See Maine Revised Statutes Title 12 Sec. 549-A
The Division of Geology, Natural Areas and Coastal Resources and the agencies having jurisdiction over state-owned lands have jurisdiction, as set forth in this subchapter, over all state-owned lands for the purpose of mineral development and mining on that land. The Bureau of Resource Information and Land Use Planning and the agencies having jurisdiction over state-owned lands may make such rules as each considers proper with respect to the authority delegated pursuant to this subchapter.
