Terms Used In Montana Code > Title 5 > Chapter 1 - Congressional, Senatorial, and Representative Districts

  • Active candidate status: means a person who has met the requirements established by the American board of genetic counseling to take the board's certification examination in general genetics and genetic counseling and has been granted the designation by the board. See Montana Code 37-49-102
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appraisal: A determination of property value.
  • Board: means the board of outfitters provided for in 2-15-1773. See Montana Code 37-47-101
  • Business entity: means any version of a proprietorship, partnership, corporation, or limited liability company. See Montana Code 37-47-101
  • Center: means the state census and economic information center established in 90-1-109. See Montana Code 5-1-201
  • Consideration: means something of value given or done in exchange for something of value given or done by another. See Montana Code 37-47-101
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the department of corrections established in 2-15-2301. See Montana Code 5-1-201
  • Department: means the department of labor and industry provided for in 2-15-1701. See Montana Code 37-49-102
  • Department: means a principal functional and administrative entity that:

    (a)is created by this chapter within the executive branch of state government;

    (b)is one of the 20 principal departments permitted under the constitution; and

    (c)includes its units. See Montana Code 2-15-102

  • Department: means the department of labor and industry provided for in Title 2, chapter 15, part 17. See Montana Code 37-40-101
  • Department: means the department of labor and industry provided for in Title 2, chapter 15, part 17. See Montana Code 37-47-101
  • Emergency: means an unforeseen combination of circumstances or the resulting state that calls for immediate action. See Montana Code 37-47-101
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Federal correctional facility: means a prison or correctional facility owned by or contracting with the United States government to incarcerate individuals convicted of a criminal offense. See Montana Code 5-1-201
  • Fraud: Intentional deception resulting in injury to another.
  • Function: means a duty, power, or program, exercised by or assigned to an agency, whether or not specifically provided for by law. See Montana Code 2-15-102
  • Genetic counseling: means the provision of the services specified under 37-49-103 by an individual who qualifies for a license under this chapter. See Montana Code 37-49-102
  • Genetic counselor: means an individual licensed in accordance with 37-49-202 to engage in the competent practice of genetic counseling. See Montana Code 37-49-102
  • Guide: means a person who is employed by or who has contracted independently with a licensed outfitter and who accompanies a participant during outdoor recreational activities that are directly related to activities for which the outfitter is licensed. See Montana Code 37-47-101
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Last known address: means an individual's last known complete street or physical address prior to the individual's incarceration. See Montana Code 5-1-201
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
  • License year: means the period indicated on the face of the license for which the license is valid. See Montana Code 37-47-101
  • Local government district: means a district based on population that is maintained by a local government primarily for election purposes and that must be substantially equal in population under the 14th amendment to the United States constitution. See Montana Code 5-1-201
  • NCHU: means the number of clients authorized to be served by an outfitter on private and state land and on any federal land where an outfitter's use of the federal land is not limited by some means other than NCHU. See Montana Code 37-47-101
  • Notarial act: means an act, whether performed with respect to a tangible or electronic record, that a notarial officer may perform under the law of this state. See Montana Code 1-5-602
  • Notarial officer: means a notary public or other individual authorized to perform notarial acts. See Montana Code 1-5-602
  • notary: means an individual commissioned to perform a notarial act by the secretary of state. See Montana Code 1-5-602
  • Outfitter: means any person, except a person providing services on real property that the person owns for the primary pursuit of bona fide agricultural interests, who for consideration provides any saddle or pack animal, facilities, camping equipment, vehicle, watercraft, or other conveyance, or personal service for any person to hunt, trap, capture, take, kill, or pursue any game, including fish, and who accompanies that person, either part or all of the way, on an expedition for any of these purposes or supervises a licensed guide or outfitter's assistant in accompanying that person. See Montana Code 37-47-101
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Participant: means a person using the services offered by a licensed outfitter. See Montana Code 37-47-101
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Peace officer: has the meaning as defined in 46-1-202. See Montana Code 1-1-207
  • Person: means an individual, corporation, business trust, statutory trust, estate, trust, partnership, limited liability company, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See Montana Code 1-5-602
  • Person: includes a corporation or other entity as well as a natural person. See Montana Code 1-1-201
  • Practice the profession of sanitarian: means :

    (a)giving advice on or enforcing compliance with state and local regulations applicable to local government jurisdictions and programs concerning food service, food processing, public accommodations, trailer courts, campgrounds, day-care centers, schools, swimming pools and spas, air pollution, solid and hazardous waste collection and disposal, sewage treatment and disposal, vector control, underground storage tanks, drinking water, land subdivision, and milk sanitation;

    (b)cooperating with government agencies on matters of public and environmental health, including epidemiological investigations and emergency response to investigations; and

    (c)providing educational and training programs in environmental standards and public health. See Montana Code 37-40-101

  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Principal: means :

    (a)an individual whose signature is notarized; or

    (b)an individual taking an oath or affirmation from the notary public but not in the capacity of a credible or other witness for the notarial act. See Montana Code 1-5-602

  • Property: means real and personal property. See Montana Code 1-1-205
  • Quorum: The number of legislators that must be present to do business.
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Montana Code 1-5-602
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sign: means , with present intent to authenticate or adopt a record:

    (a)to execute or adopt a tangible symbol; or

    (b)to attach to or logically associate with the record an electronic symbol, sound, or process. See Montana Code 1-5-602

  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Montana Code 1-5-602
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
  • State prison: means a facility listed in 53-30-101(1), (2), or (4). See Montana Code 5-1-201
  • Statute: A law passed by a legislature.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • United States: includes the District of Columbia and the territories. See Montana Code 1-1-201
  • Willfully: when applied to the intent with which an act is done or omitted, means a purpose or willingness to commit the act or make the omission referred to. See Montana Code 1-1-204
  • Writing: includes printing. See Montana Code 1-1-203
