20-1-305. School holidays. (1) Pupil instruction and pupil-instruction-related days shall not be conducted on the following holidays:

Terms Used In Montana Code 20-1-305

  • Process: means a writ or summons issued in the course of judicial proceedings. See Montana Code 1-1-202
  • Pupil: means an individual who is admitted by the board of trustees pursuant to 20-5-101 and who is enrolled in a school established and maintained under the laws of the state at public expense. See Montana Code 20-1-101
  • school: means an institution for the teaching of children that is established and maintained under the laws of the state of Montana at public expense. See Montana Code 20-6-501

(a)New Year’s Day (January 1);

(b)Memorial Day (last Monday in May);

(c)Independence Day (July 4);

(d)Labor Day (first Monday in September);

(e)Thanksgiving Day (fourth Thursday in November);

(f)Christmas Day (December 25);

(g)State and national election days when the school building is used as a polling place and the conduct of school would interfere with the election process at the polling place.

(2)When these holidays fall on Saturday or Sunday, the preceding Friday or the succeeding Monday shall not be a school holiday.
