Terms Used In Montana Justice and City Court Rules of Civil Procedure R

  • Process: means a writ or summons issued in the course of judicial proceedings. See Montana Code 1-1-202
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

After all parties served with process have appeared or some have appeared and the remaining have been defaulted, the judge, upon request of any party, shall fix a day for trial of the cause and shall provide notice of the trial date to the plaintiffs and defendants who have appeared.
