30-14-2803. (Effective October 1, 2024) Applicability. The provisions of this part apply to persons that conduct business in this state or persons that produce products or services that are targeted to residents of this state and:

Terms Used In Montana Code 30-14-2803

  • controlled: means :

    (a)ownership of or the power to vote more than 50% of the outstanding shares of any class of voting security of a company;

    (b)control in any manner over the election of a majority of the directors or of individuals exercising similar functions; or

    (c)the power to exercise controlling influence over the management of a company. See Montana Code 30-14-2802

  • Personal data: means any information that is linked or reasonably linkable to an identified or identifiable individual. See Montana Code 30-14-2802
  • Process: means a writ or summons issued in the course of judicial proceedings. See Montana Code 1-1-202
  • Sale of personal data: means the exchange of personal data for monetary or other valuable consideration by the controller to a third party. See Montana Code 30-14-2802
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201

(1)control or process the personal data of not less than 50,000 consumers, excluding personal data controlled or processed solely for the purpose of completing a payment transaction; or

(2)control or process the personal data of not less than 25,000 consumers and derive more than 25% of gross revenue from the sale of personal data.
