39-51-3103. Employer prohibited from making, requiring, or accepting deduction from wages or requiring or accepting waiver of rights under chapter — penalty for violation. (1) An employer may not, directly or indirectly, make, require, or accept any deduction from wages to finance the employer’s contributions required from the employer or require or accept a waiver of any right under this chapter by an individual in the employer’s employ.

Terms Used In Montana Code 39-51-3103

  • Contributions: means the money payments to the state unemployment insurance fund required by this chapter but does not include assessments under 39-51-404. See Montana Code 39-51-201

(2)An employer or officer or agent of an employer who violates any provision of 39-51-3102 or this section shall, for each offense, be fined not more than $1,000 or be imprisoned for not more than 6 months, or both.
