53-20-204. Rules. (1) The department may adopt rules necessary for the proper administration of this part, including but not limited to:
Terms Used In Montana Code 53-20-204
- Department: means the department of public health and human services. See Montana Code 53-20-202
- Developmental disabilities: means disabilities attributable to intellectual disability, cerebral palsy, epilepsy, autism, or any other neurologically disabling condition closely related to intellectual disability and requiring treatment similar to that required by intellectually disabled individuals if the disability originated before the person attained age 18, has continued or can be expected to continue indefinitely, and results in the person having a substantial disability. (a)the training and other standards necessary to provide crisis support services as allowed under 53-20-216; and
(b)the reimbursement rates for crisis support services provided pursuant to 53-20-216.
(2)The department shall adopt rules in cooperation with the board of nursing under which a properly trained staff member of a facility providing services to persons with developmental disabilities under this part may assist and supervise a client of the facility in taking medication if the medication is usually self-administered and if a physician has prescribed the assistance.
