(1) The State Treasurer shall consider any claim filed under ORS § 98.392 and may hold a hearing and receive evidence concerning the claim. If a hearing is held, the State Treasurer shall prepare findings and a decision in writing on each claim filed, stating the substance of any evidence heard by the State Treasurer and the reasons for the decision. A decision is a public record.

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.

(2) If the claim allowed is for property deposited in the Unclaimed Property and Estates Fund, the State Treasurer shall return the property or make payment of the proceeds of the sale of the property to the claimant.
