(1) The magistrate shall issue subpoenas for any witness within the state when requested by the district attorney or the defendant for the preliminary hearing.
Terms Used In Oregon Statutes 135.085
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.
- Subpoena: A command to a witness to appear and give testimony.
(2) If either party desires to subpoena more than five witnesses, application therefor shall be made in the manner provided in ORS § 136.570. [Formerly 133.660; 1987 c.606 § 1]
