Oregon Statutes 366.772 – Allocation of moneys to certain counties
(1) Not later than July 31 in each calendar year, the sum of $5,500,000 shall be withdrawn from the appropriation specified in ORS § 366.762 and the sum of $250,000 shall be withdrawn from moneys available to the Department of Transportation from the State Highway Fund. The sums withdrawn shall be transferred to a separate account to be administered by the Department of Transportation.

- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Department: means the Department of Transportation. See Oregon Statutes 366.005
- Highway: means every public way, road, street, thoroughfare and place, including bridges, viaducts and other structures within the boundaries of this state, open, used or intended for use of the general public for vehicles or vehicular traffic as a matter of right. See Oregon Statutes 366.005
- State highway: means any road or highway designated as such by law or by the Oregon Transportation Commission pursuant to law and includes both primary and secondary state highways. See Oregon Statutes 366.005
(2) Not later than July 31 in each calendar year, the sum of $5,750,000 shall be withdrawn from the separate account described in subsection (1) of this section and distributed to counties as follows:
(a) An amount of $750,000 shall be distributed to the following counties in the following amounts:
(b) An amount of $5,000,000 shall be distributed proportionally to counties with fewer than 200,000 registered vehicles based on a ratio of road miles maintained by each county to registered vehicles.
(3) Moneys allocated as provided in this section may be used only for maintenance, repair and improvement of existing roads that are:
(a) Not a part of the state highway system;
(b) Within counties with fewer than 200,000 registered vehicles; and
(c) Inadequate for the capacity the roads serve or are in a condition detrimental to safety.
