If a water developer fails to comply with a contract entered into with the Water Resources Commission for construction and repayment as provided in ORS § 541.730, the commission, in addition to remedies provided in ORS § 541.740, may seek other appropriate legal remedies to secure the loan and may contract with any other water developer as provided in ORS § 541.730 for continuance of construction and for repayment of moneys from the Water Development Fund used to continue construction and interest on the moneys.
