Terms Used In Kansas Statutes 39-1407
- Protective services: means services provided by the state or other governmental agency or any private organizations or individuals which are necessary to prevent abuse, neglect or exploitation. See Kansas Statutes 39-1401
- Resident: means :
(1) Any resident, as defined by Kan. See Kansas Statutes 39-1401
- Secretary: means the secretary for children and families. See Kansas Statutes 39-1430
If a resident does not consent to the receipt of reasonable and necessary protective services, or if such person withdraws the consent, such services shall not be provided or continued, except that if the secretary for children and families has reason to believe that such resident lacks capacity to consent, the secretary may seek court authorization to provide necessary services, as provided in Kan. Stat. Ann. § 39-1408, and amendments thereto.
