Terms Used In Kansas Statutes 66-1605

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Utility: means any "public utility" as defined in Kan. See Kansas Statutes 66-1601

(a) A utility may, in accordance with Kan. Stat. Ann. § 60-901 et seq. bring an action to enjoin and restrain any of the acts specified in Kan. Stat. Ann. § 66-1602.

The utility may, in the same action, seek damages for any of the acts specified in Kan. Stat. Ann. § 66-1602.

(b) It is not a prerequisite to an action pursuant to this section that the utility has suffered or been threatened with monetary damages.
