A medical oxygen retail establishment permit is required for an entity that is located in the state and that sells or delivers medical oxygen directly to patients in this state. A person located in this state, other than a pharmacy licensed under Florida Statutes Chapter 465, prior to engaging in activity for which a medical oxygen retail establishment permit is required, must file with the department a completed application on form number DBPR-DDC-223, Application for Permit as a Medical Oxygen Retail Establishment, effective April 2016, adopted and incorporated herein by reference and comply with all the requirements for permitting in Florida Statutes Chapter 499, and Title 61N, F.A.C.
